The POSH Act (Prevention of Sexual Harassment at workplace) provides protection to all women from sexual harassment at all workplaces, regardless of their ages and employment status.  It’s important to know that sexual harassment of a woman by a man is now a criminal offence and is punishable with imprisonment or fine or with both.

What Employer needs to do

An employer is legally required to comply with certain statutory requirements. One of these is the constitution of an Internal Complaints Committee ("ICC"), a body envisaged to receive complaints on sexual harassment at the workplace from an aggrieved woman, as well as to inquire into and make recommendations to the employer on the action required pursuant to its inquiry of such complaint made. Company who employs 10 or more than ten (10) people must constitute an Internal Complaints Committee, “ICC” and must ensure periodic training and sensitization against sexual harassment of all employees and members of the ICC. The consequences of and penalties for sexual harassment must be prominently displayed at the workplace, at all times.
 
ICC Committee Members
  • A Presiding Officer appointed from Senior Management (must be a woman)
  • One external member from amongst non-governmental organizations or a Lawyer.
  • At least two members representing the employees of the organization having legal knowledge/experience in social work 
·   It is essential that at least one-half of the total members so nominated shall be women. All complaints shall be made to this body which must resolve every issue impartially. The committee has the power to recommend various penalties for sexual harassment, up to termination of employment.
 
Consequence of non-Compliance

When the employer fails to constitute an Internal Committee or breaches provisions of this Act or any rules made there under, they shall be punishable with fine of fifty thousand rupees or in case of repeated defaults, the amount may exceed to double the amount and may lead to cancellation of license.
